Terms of Service

These Terms of Service ("Terms") govern your use of the Quacked application and related services ("Service") provided by Action Play Ltd ("we", "us", or "our"), BC No. 2187895, registered in the British Virgin Islands.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Description of Service

Quacked is a desktop messaging application that provides end-to-end encrypted communication with provable message deletion verified on a public blockchain. The Service is provided on an "as is" and "as available" basis.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement.

3. User Accounts and Identity

The Service uses wallet-based authentication. You are solely responsible for maintaining the security of your recovery phrase and private keys. We do not have access to your credentials and cannot recover them on your behalf. Loss of your recovery phrase may result in permanent loss of access to your account.

4. Encryption and Message Handling

All messages sent through the Service are end-to-end encrypted on your device before transmission. We do not have the ability to read, access, or decrypt message content. The Service does not log, store, or retain the contents of messages.

Message deletion is handled through a cryptographic mechanism with expiry conditions recorded on a public blockchain. Once a message's expiry condition has passed, the decryption key can no longer be derived by any party, including us.

5. Acceptable Use

You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. You are solely responsible for the content of your communications. We reserve the right to suspend or terminate access to the Service at our discretion.

6. Intellectual Property

All rights, title, and interest in the Service, including its design, functionality, and branding, are owned by us. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes.

7. Limitation of Liability

To the maximum extent permitted by the laws of the British Virgin Islands, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or use, arising out of or in connection with your use of the Service.

The Service involves cryptographic operations and blockchain interactions. We make no guarantees regarding the availability, accuracy, or reliability of third-party blockchain networks.

8. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising out of your use of the Service or your violation of these Terms.

10. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Service following any changes constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the British Virgin Islands, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the British Virgin Islands.
